to provide an online service and physical sale of goods, services, event tickets and gift vouchers by the Víno z Modra oz Association.

Art. 1 General provisions

1.1 These General Terms and Conditions (hereinafter referred to as „GTC“) of the civic association Združenie Víno z Modra, with registered office at Štúrova 79, 900 01 Modra, ID number: VAT number: 2120049646, registration number at the Ministry of the Interior VVS/1-900/90-45582 (hereinafter „Wine from Blue“) regulate mutual rights and obligations arising from the purchase contract concluded between Vino z Modra and its customer when purchasing goods and services (hereinafter referred to as „Purchase contract“) when using the Wine from Modra services, which are primarily online and offline sales of goods and services, including the sale of event tickets and dragon vouchers. (hereinafter referred to as „Services“).

1.2 The website Wine from Modra means mainly the website www.vinozmodry.sk as well as the site www.modranskepivnice.sk (hereinafter referred to as „Wine from Blue website“)

1.3 Services means all products and services presented on the Wine from Modra website, or at a permanent or temporary point of sale Wine from Modra (hereinafter referred to as "Offline sales"), for the purpose of their purchase by the Customer, who creates a shopping cart by choosing selected products and services (hereinafter referred to as „)Shopping cart“) and after filling it with all selected products, it completes the entire purchase process by paying for the contents of the Shopping Cart (it may also contain various additional services selected by the Customer depending on the current offer of Wine from Modra) (hereinafter referred to as „Purchase process“), subsequent conclusion of the Purchase Agreement and delivery of the Shopping Cart to the place chosen by the Customer, all in accordance with these GTC. In the event that it follows from the context of a specific provision of these GTC, the Purchase Cart is considered to be a collective designation of all products and services contained in it representing one separate purchase.

1.4 Only a natural person older than 18 years is authorized to use the Service (hereinafter referred to as „)Customer“). In the case of persons who do not meet the criteria for the possibility of concluding a Purchase Agreement determined by these GTC, Víno z Modra reserves the right to refuse to provide the Service to such persons.

1.5 The place of delivery means the place chosen by the Customer as part of the Purchase Process and in accordance with the conditions specified in Article 6 of the General Terms and Conditions. In the case of e-tickets and e-gift vouchers, the Customer's email box can also be such a place.

1.6 A ticket means a ticket purchased at a permanent or temporary point of sale Wine from Modra (hereinafter referred to as "Physical Ticket") or through the Wine from Modra website with a unique numerical and/or graphic code, printed by the customer, or presented to the customer through a portable electronic device (e.g. mobile phone, tablet, etc.) or a ticket printed at a permanent or temporary point of sale Wine from Modra, based on a unique numerical code (hereinafter referred to as "Online ticket") (hereinafter referred to as "Ticket").

1.7 A gift voucher is understood to mean a voucher purchased at a permanent or temporary point of sale Wine from Modra (hereinafter referred to as "Physical Voucher") or through the Wine from Modra website with a unique numerical and/or graphic code, printed by the customer, or presented to the customer through a portable electronic device (e.g. mobile phone, tablet, etc.) or a voucher printed at a permanent or temporary point of sale Wine from Modra, based on a unique numerical code (hereinafter referred to as "Online Voucher") (hereinafter referred to as "Gift voucher" or "Voucher").

1.8 An event means an event organized by Vino z Modra and for which the Customer can purchase a Ticket. Events represent services related to leisure activities. (hereinafter referred to as "Event")

1.9 By purchasing the Service, the Customer expresses his agreement with these GTC, which are available on the website www.vinozmodry.sk in the Information section.

Art. 2 Customer registration

2.1 Both registered and unregistered Customers are entitled to use the Services.

2.2 Customer registration takes place on the Wine from Modra website via the registration form (hereinafter referred to as „)Registration“). Registration is free and voluntary. The data required for registration are: name, surname of the Customer, e-mail address and password chosen by the Customer (hereinafter referred to as „)Registration data“). By sending the registration form for completion, the Customer confirms that all Registration data is true and complete for Registration needs. The name and password contained in the Registration Data are used by the Customer as login data to his account created on the Wine from Modra website for the purpose of using the Services (hereinafter referred to as „)Account“).

2.3 The successful completion of the Registration will be confirmed by Wine from Modra to the Customer at the e-mail address provided by him. After such confirmation, the Customer will be entitled to use the Wine from Modra Services through his Account as a registered Customer.

2.4 The Customer is obliged to keep the Registration Data complete, accurate, true and updated, i.e. in case of their change, he undertakes to update them in his Account the next time he logs in to it. Wine from Modra is in no way responsible for the consequences that arise for the Customer or third parties as a result of false, incomplete, incorrect or unupdated Customer data or as a result of intentional or unintentional disclosure or misuse of Customer Registration or other data related to the use of the Services (hereinafter referred to as „)Customer data“) to third parties.

2.5 The Customer to whom the Account is registered is fully responsible for all actions carried out through the Víno z Modra Web Account. The Customer is obliged to immediately inform Vino z Modra of any suspicion of misuse of Customer Data by a third party and to take all necessary steps to prevent the continuation or re-abuse of Customer Data. In case of reasonable concern about the misuse of Customer Data, Vino z Modra is entitled to block the Account and invite the Customer to change its Registration Data.

2.6 The Customer is entitled to cancel his Account at any time and without giving a reason. Wine from Modra reserves the right to cancel or suspend the Customer's access to his Account at any time, especially in cases where there is a reasonable fear of Wine from Modra from the misuse of the Customer's data, in the event of a violation of the Customer's obligations arising from the General Terms and Conditions or the Customer's actions damaging the interests of Wine from Modra or his other illegal actions.

2.7 The account is terminated by its cancellation according to point 2.6. GTC or by the death of the Customer or by the cancellation of the Wine from Modra or by the cancellation of the provision of the Service by the Wine from Modra. The termination of the Account does not terminate the rights and obligations of the Customer, which, due to their nature and nature, should last even after the termination of the Account.

Art. 3 Conclusion of the contract and validity of the terms

3.1 The offer of Products placed on the Wine from Modra website does not constitute a binding offer from the Wine from Modra to be purchased by the Customer in accordance with the legal order of the Slovak Republic. Wine from Blue does not guarantee the availability of Products offered on the Wine from Blue website, regarding the type or quantity of the Product. The availability of the Products is influenced by their availability to individual farmers or suppliers of Wine from Modra as well as from the distribution capacities of Wine from Modra or other entities participating in the distribution structures through which the Services are provided.

3.2 By implementing the Purchase Process, the Customer creates a one-sided proposal for Wine from Modra for the delivery of the selected Products together with their delivery to the Place of Delivery and subsequent conclusion of the Purchase Agreement between Wine from Modra and the Customer. Receipt of such a unilateral proposal is confirmed in the form of a notification on the implementation of the Purchase Process, including a confirmation of payment of the Approximate Price (defined below) (hereinafter referred to as „)Notification“). The notification is delivered to the Account and to the Customer's e-mail address. The Purchase Agreement between the Customer as the buyer and Vín z Modra as the seller is concluded upon receipt of the Customer's Shopping Cart connected with their viewing upon receipt.

3.3 For the avoidance of doubt, none of the actions of Wine from Modra connected with the provision of the Service until the moment of acceptance of the Products by the Customer according to the conditions set forth in these GTC are considered to be acceptance of the Customer's proposal to conclude a Purchase Agreement with Wine from Modra. In the event that the Customer refuses to accept the Shopping Cart or does not accept it at the Delivery Time (defined below) or for Substitute Delivery (defined below), the Customer is obliged to pay Vína z Modra a contractual penalty in the amount of the Approximate Price and Delivery Costs (defined below), or Packaging Costs (defined below). Wine from Modra unilaterally sets off the claim from such a contractual penalty against the Customer's claim for a refund for the unclaimed Shopping Cart, with which the Customer expresses express consent.

Art. 4 Purchase price and its purposes

4.1 The purchase price is the price of Services on the Wine from Blue website (hereinafter referred to as „)Purchase price“).

4.2 The purchase price does not include the costs associated with (i) the delivery of the Products to the Customer at the Place of Delivery (hereinafter referred to as „)Delivery costs“), (ii) in the case of the Customer's choice of packing the contents of the Shopping Cart in bags or other offered packaging options with Wine from Blue or with such additional packaging (hereinafter referred to as „Packaging costs“), (iii) with the provision of other additional Blue Wine Services chosen by the Customer, such as special modification of the Product. Packaging costs are considered to be costs related to the packaging of Products beyond the mandatory provision of packaging of selected Products (e.g. wine) in accordance with the relevant legal regulations.

4.3 Delivery costs and Packaging costs will be charged to the Customer depending on the amount of the Purchase Price and in accordance with the relevant price lists relating to the type of service provided by Wine from Modra.

Art. 5 Payment and delivery conditions

Payment terms

5.1 In the case of purchasing Services via the Web on the Wine from Modra website, Wine from Modra enables Customer payments to be made exclusively through Visa, Visa Electron, Master Card and Maestro payment cards, as the last step of the Purchase Process. The purchase process, or part of it, may take place on the website, depending on the current technical solution of Wine from Modra www.vinozmodry.sk or www.modranskepivnice.sk

5.2 For the avoidance of doubt, it applies that it is not possible to pay for Services on the Víno z Modra website in cash, meal tickets, purchase vouchers or any other payment method than that specified in point 5.1. GTC.

5.3 In the case of the purchase of Services via the Web on the Web, Wine from ModraWine from Modra, on the day following the futile expiry of the period determined pursuant to point 8.12 (b) of the GTC, shall deliver to it the email address entered by the Customer, or to its Account, a proof of purchase containing, in particular, the following particulars: (i) corporate particulars of Wine from Modra, (ii) date of implementation of the Purchase Process, (iii) type, quantity and price of Products from the Shopping Cart, (iv) and Purchase Price (hereinafter referred to as „Invoice“). Payment is made only if the Customer receives an Invoice from Wine from Modra. Depending on the current technical solution of Wine from Modra, the website www.vinozmodry.sk or www.modranskepivnice.sk may contain proof of purchase and any other information delivered from the domain vinozmodry.sk and/or modranskepivnice.sk

5.4 In the case of purchasing Services through Offline sales, Wine from Modra may decide to enable execution through payment cards and/or cash.

Delivery conditions

5.6 Wine from Modra provides the purchase of physical goods exclusively within Slovakia, or in a designated territory, which is listed on the Wine from Modra website in the Delivery Availability section. Thus, the Customer can be provided with the Service only at the Place of Delivery, which is located in the territory determined according to the previous sentence. The purchase of Online tickets and Online gift vouchers takes place by delivery to the email address specified by the customer.

5.7 Part of the Purchase Process is also confirmation by the Customer that he has familiarized himself with the wording of the General Terms and Conditions and expresses his agreement with them. By completing the Purchase Process, the Customer also, in accordance with the provisions of § 3 par. 2 point (b) of Act no. 102/2014 Coll. Vína z Modra gives consent to the information before the conclusion of the Purchase Agreement, as a contract concluded outside the Seller's premises according to § 3 par. 1 of Act no. 102/2014 Coll. provided in the form of an entry on another durable medium instead of their documentary form. The Seller will fulfill his obligation in accordance with the above so that in the Notification sent to the Customer there will be a link after clicking on which the Customer will be able to download the General Terms and Conditions at any time, current at the time when the Purchase Process was carried out, so that the Customer can familiarize himself with them whenever necessary for him.

5.8 In order to deliver physical products, the Customer shall provide the following personal data during the implementation of the Purchase Process: the Customer's first and last name, the Customer's telephone number and email address, the place of delivery in the range of house number, street, postal code and possibly floor number and apartment number if it is an apartment building, and for the purpose of delivering Online Tickets and Online Vouchers, he shall provide the following personal data during the implementation of the Purchase Process: name and surname of the Customer, customer's email address (hereinafter referred to as „Delivery data“).

5.9 After completing the Purchase Process, Vino z Modra will send the Customer a Notification summarizing the entire Purchase Process, indicating in particular the types and quantity of Products, Purchase Price, Delivery Costs, Packaging Costs, Delivery Time.

5.10 In the event that the Shopping Cart contains Products that will not be available, Wine from Modra is entitled to inform the Customer about the unavailability of the Product he has chosen in the notification preceding the Notification and to offer him a replacement product that, by its nature, is as close as possible to the Product he originally chose by the Customer (hereinafter referred to as „)Replacement product“). The customer is entitled, but not obliged, to request Wine from Modra for its delivery after such an offer of the Replacement Product. Depending on the Customer's feedback (either accepting the Replacement Product or rejecting it), the Approximate Price will be adjusted in an appropriate manner, as well as Delivery Costs, Packing Costs and possibly other delivery conditions of the Shopping Cart if the inclusion of the Replacement Product has an impact on the above.

5.11 Wine from Modra undertakes to deliver the Shopping Cart to the Customer in accordance with the entered Delivery data, specifically to the entrance door of the apartment building, family house or, in the case of a lockable fence of the apartment or family house, first, a lockable door. In the event of a request by the Customer to deliver the Shopping Cart to a specific floor of an apartment building or in front of the front door of a specific apartment, Wine of Blue shall make reasonable efforts, given the specific circumstances of such delivery, to comply with the Customer's request and on condition that Wine of Blue is entitled to enter the Customer's designated building/space, the no obstacle (factual or legal) is prevented from entering the building and there is no danger to life, health, Products or other property.

5.12 Wine from Modra or a third party authorized by him to deliver the Shopping Cart (hereinafter referred to as „Courier“(notify the Customer on the day of delivery of the Shopping Cart by sending an SMS message to the phone number entered by the Customer in the Shopping Process Delivery time at which the Shopping Cart will be delivered to him by courier. In the event that the Customer is not eligible to receive the Shopping Cart, he is obliged to contact the Courier immediately after sending such a notification SMS message to the phone number indicated in the notification SMS and agree with him on an alternative place of delivery of the Shopping Cart. The courier reserves the right to decide whether to deliver to such an alternative designated place of delivery, primarily depending on its logistics capacities and other delivery schedule.

5.13 If the Customer is not qualified to take it over at the Place of Delivery at the time of delivery of the Shopping Cart, Vino z Modra will send him a link that the Shopping Cart has been delivered via a notification in an SMS message and to the e-mail entered by the Customer in the Shopping Process and will inform him of an alternative delivery date Shopping Cart (hereinafter referred to as „)Replacement delivery“). Substitute delivery will be determined by Wine from Modra due to the nature of the Products in the Shopping Cart, especially taking into account the fact that there may be Perishable Products in the Shopping Cart, while Substitute delivery will be determined no later than two days after the day that was determined as Delivery Time. In the event that the Customer's ineligibility for receiving the Products was only temporary and shortly after leaving the link, the Customer contacts Wine from Modra using the contact details provided in the link and may request a repeated attempt to deliver the Shopping Cart. In the event that repeated delivery of the Products cannot be carried out even in the form of Replacement Delivery, the provision of the Service by Vín from Modra is canceled.

5.14 In the event that the Products are not handed over at the Time of delivery and the Place of delivery in cases where (i) exclusively for reasons on the part of the Customer, the Purchase Agreement was not concluded at least twice within one month or (ii) the Customer acted in violation of these GTC or relevant generally binding legal regulations or interests of Blue Wine, síno z Modra reserves the right to refuse to take any further actions aimed at concluding a Purchase Agreement with such Customer.

5.15 In case of incapacity to take over the Products delivered by Wine from Modra, the Customer may entrust the taking over of the Products at the Time of delivery and Place of Delivery only to a person older than 18 years, as long as there are goods in the delivered Products, the acquisition of which is conditional on reaching the statutory age limit of 18 years.

5.16 When handing over the Shopping Cart, the Courier is entitled to demand proof of the minimum age required under these GTC and/or relevant legal regulations. In the event that the fulfillment of the condition of reaching the minimum age is not proven in a credible manner, the Purchase Agreement will not be concluded.

5.17 The Customer is obliged to check the physical integrity and completeness of the delivered Products in the Shopping Cart, including their packaging, when receiving them from the Courier, and to confirm this fact on the delivery note provided by the Courier. In the event that the Customer discovers that the Product or its packaging is mechanically or otherwise visibly degraded, he is obliged to immediately notify the Courier of this fact and, in cooperation with him, state this fact on the delivery note. Regardless of damage or other deterioration of the Products according to the previous sentence, the Customer is obliged to take over the Shopping Cart and subsequently initiates a complaint procedure according to Art. 8 GTC.

5.18 The purchase of Online tickets and Online gift vouchers takes place by delivery to the email address specified by the customer. The numerical and/or graphic code on the Online Ticket is valid only once, i.e. that any further submission of a unique numerical and barcode will not take into account the Online Ticket submitted in this way and will not be filled based on it. Submitting an e-mail confirmation does not automatically entitle you to issue an Online Ticket, regardless of who submits the confirmation. The customer is therefore obliged to protect the unique number (transaction number) from theft or use by another person.

5.19 Wine from Modra is not responsible for the misuse of the ticket by a third party, and the staff Wine from Modra does not check the method of acquisition of the submitted valid ticket or Onlien ticket; The customer is obliged to protect the ticket from theft or use by another person.

5.20 Wine from Modra is not responsible for the correct delivery of the Online Ticket and Online Gift Voucher in case of an incorrectly entered Customer email address.

Art. 6 Application of the Gift Voucher

6.1 Ownership of the Gift Voucher entitles the Customer to exchange for the Event Ticket, which is indicated on the Gift Voucher. Before the start of the event, the Gift Voucher must be exchanged for a Ticket at the Information Stand.

6.2 The basis for using a Gift Voucher is a unique numerical code. The customer is obliged to protect this code from damage and also from its misuse by third parties (e.g. by posting photos). In the event that the code indicated on the voucher is invalid or has been demonstrably used earlier (this fact will be stored in the Operator's system), the Gift Voucher will not be accepted. In such a case, the Customer is not entitled to any compensation or compensation from the Operator.

6.3 The gift voucher can be used for film performances held no later than the last day of validity of the given Electronic gift voucher.

Art. 7 Refusal to redeem a Gift Voucher with Wine from Modra

7.1 The Provider may refuse to redeem the Gift Voucher for the following reasons:

(a) The gift voucher was presented after its expiry date

(b) The gift voucher has already been redeemed;

(c) The gift voucher has been cancelled owing to withdrawal

(d) The application of the Gift Voucher would be contrary to the applicable legislation.

(e) The gift voucher has been invalidated in such a way that it is impossible to verify its authenticity, validity or to read by machine the electrical data.

Art. 8 Conditions of events

8.1 A ticket is a confirmation allowing its owner (who does not have to be a Customer) to enter the Event and obtain the products and services that the purchased Ticket contains. The ticket cannot be offered for resale, returned to sale, exchanged or arbitrarily printed with a duplicate. Modifying, falsifying or copying tickets is a crime.

A. Modran Wine Day 2026 event

Ticket content

(a) Possibility to visit outdoor or indoor tasting areas (hereinafter referred to as "Tasting areas") individual wineries (groups of wineries participating in the event (hereinafter referred to as"Winery"). Multiple Wineries can be placed in one tasting area,

(b) Tasting glass Wine of Blue,

(c) Wine tasting from the current offer in individual Wineries. The size of the tasting sample is not determined and is at the discretion of the Winery, but usually it is 0.01 l. The winery is not obliged to provide the Customer with a repeated sample. The current offer of wine may change in individual Wineries during the event (hereinafter referred to as "Tasting"),

(d) 3 bonus tickets for the purchase of wine in the Winery, according to the current offer, worth EUR 5 each. Bonus tickets can be used separately or together and can be combined with cash. Bonus tickets are only valid during the event of the given year and cannot be exchanged for cash. It is not possible to issue a difference from the purchase price from bonus tickets. You can hand in unused tickets at the information stand. When using the bons ticket, it is necessary to hand it over to the winery, where the use takes place

(e) Bonus ticket for a one-off 10% discount on purchases at the Winery. Discount bonus tickets cannot be combined with other discount bonus tickets. When using the bonus ticket for a one-time discount, it is necessary to hand it over to the winery, where the use takes place

(f) A sign (generally in the form of a bracelet) which confirms the purchase of an Online Ticket and entitles you to wine tasting in the Winery within the meaning of these GTC and which must be visibly worn during a visit to the tasting areas.

Ticket pickup

Tickets for the Modran Wine Day event can be picked up exclusively on the day of the event from 10:00 a.m. to 9:00 p.m. at the Information Stand of the Wine from Modra Association on Modran Square (Štúrova Street) under the statue of Ľudovít Štúr (hereinafter referred to as "Information stand"). To pick up tickets, it is necessary to prove the name of the customer and the assigned personal PIN code and/or QR code. The organizer is entitled to request additional information from the order, including email and phone number, in case of doubt.

B. Wine Market 2026 event

(a) Tasting glass Wine of Blue, which is refundable to the value of EUR 5, - in so far as it is returned empty and undamaged by the time indicated at the Information Stand, the

(b) Wine tasting from the current offer in individual Wineries. The size of the tasting sample is not determined and is at the discretion of the Winery, but usually it is 0.01 l. The winery is not obliged to provide the Customer with a repeated sample. The current offer of wine may change in individual Wineries during the event (hereinafter referred to as "Tasting"),

(c) 1 bonus tickets for the purchase of wine in the Winery according to the current offer, worth EUR 5, - EUR. Bonus tickets can be used separately or together and can be combined with cash. Bonus tickets are only valid during the event of the given year and cannot be exchanged for cash. It is not possible to issue a difference from the purchase price from bonus tickets. You can hand in unused tickets at the information stand. When using the bons ticket, it is necessary to hand it over to the winery, where the use takes place

(d) Bonus ticket for a one-off 10% discount on purchases at the Winery. Discount bonus tickets cannot be combined with other discount bonus tickets. When using the bonus ticket for a one-time discount, it is necessary to hand it over to the winery, where the use takes place

(e) A marking (usually in the form of a bracelet) which confirms the purchase of an Online Ticket and entitles you to wine tasting in the Winery within the meaning of these GTC and which must be visibly worn during a visit to the tasting areas.

8.3 Rules for fair use of the ticket

Spare cups

8.4 Wine from Modra is not responsible for the loss and damage of the tasting glass, but it will develop maximum effort so that Customers have spare glasses available for purchase, usually at the Information Stand as well as at selected Winemakers in accordance with the price list available at the Information Stand.

Rights and obligations

8.5 The customer has the right to participate in the Tasting. If the Customer does not participate in the Tasting, he does not have the right to withdraw from the Agreement or the right to a refund of the Purchase Price.

8.6 The customer is obliged to respect these GTC, warnings and instructions, with which the staff of Víno z Modra, as well as the staff of individual Wineries, as well as regulations of local and state administration bodies and current government measures, especially with regard to measures to prevent the spread of COVID-19.

8.7 The customer acknowledges that the subject of the Tasting is the consumption of alcoholic beverages, and therefore participation in the Tasting is not allowed to persons under the age of 18.

8.8 Wine from Modra or individual wineries, due to the nature of the event and tasting areas of the wineries, do not guarantee the accessibility of these areas or the availability and accessibility of toilets, and for this reason the Customer is not entitled to a discount or refund of the entrance fee.

8.9 The customer is obliged to respect the capacity of the event and tasting areas of the Wineries. If the customer does not fit in the tasting area at the selected time due to its capacity, he is not entitled to a discount or refund of the entrance fee.

8.10 When moving in the premises of the Event, in the premises of the Wineries, the Customer is obliged to exercise extreme caution, especially during movement up stairs, lowered areas, sidewalks and roads, especially in view of the reduced (safety) lighting in the tasting areas of the Wineries, stairs, narrow and low areas, increased movement of cars on the roads, etc. Arrival and departure from the Wineries is possible at your own risk and responsibility.

8.11 The customer must not disturb other customers during the event beyond the level usual for the given nature of the event by inappropriate behavior.

8.12 Wine from Modra and individual wineries reserve the right to prevent access to persons inappropriately dressed (e.g. dirty clothes, etc.), persons with a covered face (in a way that makes it impossible or difficult to assess age, and thus the availability of tastings), persons with neglected personal hygiene, persons violating the norms of decent social behavior or arousing public outrage, persons who suffer from serious contagious diseases that threaten the health of other customers and staff Wine from Modra, whether to persons who are not authorized to enter on the basis of binding legal regulations issued by state administration bodies, as well as to persons who are aggressive and clearly under the influence of alcohol or other narcotic and psychotropic substances, as well as to request such persons to leave the premises of the Winery. In such a case, the staff of the Winery also has the right to refuse the Customer a Tasting in whole or in part. In such a case, the customer is not entitled to compensation.

8.13 The customer is obliged to pay attention to his deferred personal belongings; Wine from Modra does not take responsibility for them and does not provide a service for storing customers' personal belongings. The customer is obliged to store personal belongings or oversized luggage (including strollers, scooters) in the designated places in the dressing room or shopping center storage room. Cinema City does not have storage space for these purposes and is not obliged to store customers' personal belongings or oversized luggage.

8.14 Wine from Modra is not responsible for damage to the customer's health or to things brought by the customer to the premises of individual wineries, unless the damage is directly caused by Wine from Modra. If the Customer causes damage as a result of non-compliance with the Visiting Regulations or other instructions to himself, or to other customers or a third party, he is responsible for it himself.

Security

8.15 In case of theft, robbery or other crime or misdemeanor, it is always necessary to immediately contact the city or state police.

8.16 Visitors ensure the provision of first aid by calling the rapid rescue service or components of the integrated rescue system. The first aid kit is located at the entrances to the Markets.

8.17 Every visitor to the Event is obliged to actively prevent injuries, damages or other direct or indirect damages or other consequences that could arise for visitors anywhere in the event premises.

8.18 In the event of a fire, the visitor contacts the fire rescue service.

8.19 In order to ensure the safety and health of Customers and to prevent unwanted consequences and inconveniences, we recommend considering participating in the event for pregnant women and people under the influence of alcohol and addictive substances.

8.20 Drink responsibly.

Making camera and photo recordings of events

8.21 The organizer processes personal data in the scope of photographs, video recordings and audio-visual recordings of participants in a public event organized by the organizer for the purposes of:

  • publication of a photo, video or audio-visual recording of the person concerned as a participant in a public event in electronic form on the organizer's website www.vinozmodry.sk as well as on his social media accounts Facebook, Instagram and YouTube in order to promote the public event, the operator and his activities;

  • publication of a photo of the person concerned in printed form in the operator's printed marketing materials with the aim of promoting the public event, the operator and its activities;

  • proof that the public event in question took place.

Art. 9 Complaints Services purchased on the Web Wine from Blue

9.1 The provisions of this article of the General Terms and Conditions apply to Customers who, when concluding the Purchase Agreement, are in the position of a consumer - that is, do not act within the scope of their business activity, employment or profession.

9.2 The Customer is entitled to complain about the Product (hereinafter referred to as „)Complaint“) in the event that, contrary to the agreement in the Purchase Agreement, the purchased Product shows defects (relating to the quantity, quality, other declared property of the Product with Blue Wine or even legal defects) (hereinafter referred to as „Defect“). In accordance with point 6.14 of the General Terms and Conditions, the customer is obliged to inspect the Products upon receipt. If he does not do so, he can make claims from the Defects detected during this inspection, only if he proves that he already had these Defects in the Product at the time of its receipt .

9.3 In the event that it is not a registered Customer in accordance with Art. 2 GTC, the Customer can make a Complaint via email or help desk on the Wines from Modra website using the procedure indicated on the Wines from Modra website.

Art. 10 Method of making a claim

10.1 The customer is entitled to make a Complaint in electronic form through his Account in the Complaint section. After filling out the complaint form, which the Customer is obliged to fill out truthfully and completely, the Customer's request for a complaint will be created with a confirmation of the registration of the Complaint (hereinafter referred to as „)Ticket“() containing a unique numerical code assigned to the given Complaint, which the Customer is obliged to keep for the purposes of the next complaint procedure. In the event that the complaint form is not filled out properly, the Ticket will not be created for the Customer and he will be notified by system notification of deficiencies in the registration form and invited to eliminate them. Confirmation of the correct filling in of the data is the creation of the Ticket.

10.2 In the event that, after receiving the Ticket or the Complaint applied according to point 8.4 of the General Terms and Conditions, Wine from Modra finds that for the purposes of the Complaint it is necessary to provide additional information or submit additional documents by the Customer, the Customer will be invited to provide the necessary cooperation through the Ticket System (defined below) or the Wine from Modra helpdesk. For this purpose, the customer undertakes to regularly check the status of handling the Complaint in the Ticket system or in the Wines from Modra help desk (. The customer acknowledges that in the event of failure to provide the requested cooperation from the Wine from Modra, proper processing of the Complaint will not be possible and the Complaint will be stopped by the Wine from Modra.

10.3 In the case of applying a Complaint according to point 8.3 of the General Terms and Conditions, all notifications related to the Complaint are notified to the Customer by delivering a message to the account created for each Ticket separately (hereinafter referred to as „)Ticket systemm“). In the case of applying a Complaint according to point 8.4 of the General Terms and Conditions, all notifications regarding the Complaint are notified to the Customer via the Wines of Blue help desk (hereinafter referred to as „)Helpdesk announcement“).

10.4 The customer is obliged to provide the following information in the complaint form:

(a) Customer's first and last name, the address of the Place of delivery and the address of residence (in the case where this is not the same address as the Place of delivery)

(b) Customer's contact details in the scope of: telephone number, e-mail address;

(c) The precise and unambiguous identification of the Product, expressed by indicating its code, which is the subject of the Complaint

(d) The code of the Shopping Cart in which the claimed Product appeared

(e) A detailed description of the Defects of the Product (if possible with a photograph of the Defects);

(f) the choice of the method of dealing with the Complaint within the meaning of paragraphs 8.15. and 8.16. GTC;

(g) the date of filing of the Complaint

(h) Within the complaint form, the Customer is required to upload a scan of the Invoice confirming the Customer's purchase of the Product.

10.5 In the event that the choice of a claim from Vada under point 8.8 (f) of the GTC does not occur, the Customer leaves the right of option to Wine from Modra at its sole discretion.

10.6 The customer, in accordance with the instructions contained in the Ticket or Helpdesk notification, is obliged to send the claimed Product to the address of the registered office of Wine from Modra at his own expense no later than 7 days from the date of receipt of the Ticket or Helpdesk notification. The Customer will be informed about the receipt of the claimed Product through the Ticket System or Helpdesk notification. With the delivery of the claimed Product, the deadlines for the Wine from Modra to notify the method of handling the Complaint and to separately handle the Complaint begin to run. For the proper handling of the Complaint, it is necessary that the claimed Product, if it is possible due to the circumstances, is complete, clean, in accordance with hygiene standards and in a condition that does not endanger the health or property of the persons involved in handling the Complaint.

Art. 11 Time limits related to Complaints

11.1 If it is possible due to the circumstances of the Complaint, the method of handling the Complaint will be determined by the Wine from Modra immediately in the Ticket or Notification Helpdesk. In other cases, he shall notify the Customer of Wine from Modra no later than 3 working days from the date of application of the Complaint, in justified cases, especially if a complex technical evaluation of the condition of the Product or service is required, no later than 30 days from the date of application of the Complaint.

11.2 After determining the method of handling the Complaint, the Complaint will be processed immediately, in justified cases the Complaint can be processed later, while the processing of the Complaint should not take longer than 30 days from the date of proper application of the Complaint. After the futile expiration of the deadline for processing the Complaint, the Customer has the right to withdraw from the Purchase Agreement or has the right to exchange the Product for a new Product.

Art. 12 Claiming for Defects

12.1 The customer is obliged to file a Complaint immediately after discovering that the purchased Product has a Defect, but at the latest:

(a) until the expiry of the guarantee period (in the case of non-food products, that is 24 months) or of another period in the cases of food products, indicated on the Product or in its accompanying documentation, during which the Product is to retain the characteristics declared by the Blue Wine (best before or expiry date)

(b) for Perishable Products, the Complaint must be made no later than the day following the day on which the Product was or should have been properly delivered; that is, in the case of Substitute Delivery, the period according to this point does not begin at the moment of Substitute Delivery, but from the moment of Delivery Time, when the Product was originally supposed to have been delivered, unless there are circumstances on the part of the Customer preventing him from taking over the Shopping Cart;

12.2 In the event that the Customer does not exercise his rights from liability for Defects within the time limits specified under this point, such rights shall expire.

12.3 The warranty period is extended if the claimed Product was taken over for repair, by the time from the proper application of the Claim until the day when the Customer was obliged to take over the item after repair. Wine from Modra is obliged to issue a confirmation to the Customer about when he exercised this right, as well as about the repair and its duration. If the Complaint is processed by replacing the Product, the Warranty Period begins again from the date of receipt of such replaced Product. If the Customer does not receive the Product in time after processing the Complaint, the Warranty Period will begin to run from the day he was obliged to collect the item after the Complaint.

12.4 The customer is obliged to store the purchased Product according to the manufacturer's instructions on the packaging, or in a manner usual and appropriate for the given type of goods. The complaint will not be accepted if the Customer clearly did not comply with the manufacturer's instructions or the defect was caused by improper handling and storage of the Product.

12.5 If it is a Defect that can be removed, the Customer has the right to have it removed free of charge, on time and properly, or to have the defective item replaced with a defect-free one. Wine from Modra is obliged to remove the defect without undue delay or replace the Product with the defect for a flawless one. Instead of removing the Defect, the Customer may request the replacement of the item, or if the Defect concerns only a part of the item, the replacement of the part, if this does not result in unreasonable costs for the Vina z Modra considering the price of the Product or the severity of the Defect. Wine from Modra can always replace the defective Product with a flawless Product instead of removing the Defect, if this does not cause serious difficulties for the Customer.

12.6 If it is a Defect that cannot be removed and which prevents the Product from being properly used as a Defect-free Product, the Customer has the right to exchange the Product or withdraw from the Purchase Agreement. The same rights belong to the Customer, if it concerns removable defects, but if the Customer cannot properly use the Product due to the reappearance of the defect after repair or due to a larger number of defects. If it concerns other irreparable defects that do not prevent the Product from being used properly, the Customer has the right to a reasonable discount on the price of the Product.

12.7 Food defects, including fruits and vegetables, are always considered indelible.

12.8 If the Product sold at a lower price has a Defect for which Blue Wine is responsible, the Customer is entitled to provide an appropriate discount from the purchase price of the Product instead of replacing the defective Product.

12.9 If the Customer made a Complaint in the case of a non-food Product within the first 12 months of purchase, Vino z Modra can handle the Complaint by rejecting it only on the basis of a professional assessment. Regardless of the result of the professional assessment, the Customer cannot be required to pay the costs of the professional assessment or other costs related to the professional assessment. Wine from Modra is obliged to provide the Customer with a copy of the expert assessment justifying the rejection of the Complaint no later than 14 days from the date of processing the Complaint.

12.10 If, in the case of a non-food Product, the Customer made a Complaint after 12 months from the purchase and Wine from Modra rejected it, the person who processed the Complaint is obliged to indicate in the Complaint Record (defined below) to whom the Customer can send the product for expert assessment. If the Product is sent for expert assessment to a designated person, the costs of the expert assessment, as well as all other related costs, are borne by Wine from Modra, regardless of the result of the expert assessment. The warranty period does not expire during the performance of the expert assessment.

12.11 The expert assessment must include: (i) the identification of the person who performs the expert assessment, (ii) the exact identification of the product under consideration, (iii) a description of the condition of the product, (iv) the result of the assessment and (v) the date of the expert assessment.

12.12 Wine from Modra is responsible for defects in the Product that occur after the Customer takes over the Goods during the warranty period (hereinafter referred to as „)Warranty period“). For a Product of a food nature, the Warranty Period is also considered to be the period that ends on the day marked on the Product as the expiration date or shelf life. If a period of use is specified directly on the sold Product, on its packaging or in the related instructions, the Warranty Period will not end before this period is fulfilled.

12.13 The warranty period begins to run from the moment the Product is taken over by the Customer or, in the case of Substitute Delivery, from the moment the Delivery Time was supposed to be originally delivered, unless there are circumstances on the part of the Customer preventing him from taking over the Product.

12.14 Liability of Wine from Modra for Defects is excluded in cases where:

(a) Was a Defect (defined below) caused by the Customer (eg, improper handling of the Product or improper storage)

(b) The Customer has been expressly notified of the Defect in the goods and a discount has been granted to the Customer in connection therewith (including Products with an approaching expiry date)

(c) There has been no notification of an apparent Defect in the Customer's acceptance of the Product

(d) By mechanical damage, accidental deterioration, accidental deterioration, damage to the Product by unavoidable and/or unforeseeable events on the part of the Customer

(e) Were Defects caused by wear and tear of the Product in its improper or excessive use or in the lack of care required by the goods due to their nature and durability

(f) Was a Product used in conditions which do not correspond, by their humidity, chemical and mechanical effects, to the natural environment

(g) The protective seals on the Product have been breached;

(h) The defect was caused by an unauthorized person interfering with the Product or its components

(i) the Defect is claimed after the expiry of the periods referred to in point 8.12. GTC;

12.15 Wine from Modra is obliged to provide the Customer with a guarantee in writing (hereinafter referred to as „)Warranty card“) unless:

(a) The Customer shall request it and The nature of the product makes it possible

(b) The nature of the Product so requires

(c) in the case where the nature of the Product allows it, the Invoice may also be considered as a Warranty Certificate.

12.16 For the purposes of legal relations arising from the Purchase Agreement, the Invoice is considered a document decisive for determining the duration of the Warranty Period, which will also state the date of receipt of the Shopping Cart by the Customer.

Art. 13 Change and cancellation of the event

13.1 The offer of services at the Events and their use may be limited due to the adverse weather situation, due to circumstances related to the season, the health status of the performers, etc.

13.2 Wine from Modra reserves the right to change the Event. In the event that serious reasons arise that are related to the restriction of the offered Event, the Wine from Modra website will inform Customers and those interested in the Event about the change, cancellation, alternative date of the Event, or the place and time of refund of the entrance fee.

13.3 The Customer has no right to a refund or reduction of the price of the Ticket if he has attended the Event or if he has used the proposed new date of the Event, and he is also not entitled to reimbursement of other expenses (transport to the venue of the Event, accommodation, meals, delivery of the Ticket, etc).

13.4 When changing the Event – of reducing the scope of services provided, funds representing the relevant part of the Ticket price are returned to the Organizer to a reasonable extent determined by the Organizer, unless the Organizer specifies otherwise. The place, time and method of returning the relevant part of the entrance fee will be determined by the Organizer and notified to the Ticket Owners via the website www.vinozmodry.sk. In the event that the change only concerns a change in the venue and/or date of the Event, without limiting or reducing the scope of the services provided, the Ticket Holder will not be entitled to a refund of the Entry Fee or part of it.

13.5 When the Event is canceled, the funds representing the Ticket price are returned by the Organizer without undue delay to the Ticket Owners after the announcement of the cancellation of the Event by the Organizer is published. Ticket holders are entitled to claim the right to refund the entrance fee within the legal period set by the law. The place, time and method of refunding the entrance fee will be determined by the Organizer and the Ticket Customers will be notified via the Wine from Blue website.

13.6 Wine from Modra is not obliged to return the price of the Tickets to the Ticket Owners or to pay them or provide any compensation in the event that the Event is cancelled

(a) for reasons which were caused by an unavoidable event not originating in the Wine of Blue operation, in particular but not only for reasons on the part of the performers (eg deterioration of health, etc.), force majeure, natural disasters, adverse weather conditions or weather, strikes, demonstrations, wars, uprisings, riots, terrorist attacks or suspicions thereof, or prohibitions of public events or Events by any public authority, court or legal regulation, or (ii) for reasons on the part of the Customer (§420a paragraph 3 of the Civil Code), or (iii) for any other similar reasons listed in the General Terms and Conditions, all this even if, instead of the canceled Event, a replacement Event is not held on an alternative date.

13.7 In the case of a particularly serious reason, the organizer can proceed with a partial refund of the ticket exclusively before the event itself. This does not apply to the case of an early event due to bad weather.

Art. 14 Processing of Complaints

14.1 The Customer is informed about the handling of the Complaint by delivering a notice via the Ticket System or the Notice Helpdesk.

14.2 After processing the Complaint, Vino z Modra will issue a written confirmation of its equipment to the Customer (hereinafter referred to as „)Complaint record“) no later than 30 days from the date of proper application of the Complaint. The complaint record will be delivered via the Ticket System or the Wine from Modra help desk. The Customer will be informed about its delivery by sending a notification via e-mail and/or SMS message.

Art. 15 Right to withdraw from the Purchase Agreement concluded through the Wine from Modra website

15.1 In the case of a purchase through the Víno z Modra Web, the Customer is entitled to withdraw from the Purchase Agreement, or part of it, even without giving a reason, within 14 days from the date of receipt of the Purchase Cart by the Customer or a third party designated by him, with the exception of the carrier, but no later than the expiration of the Warranty Period.

15.2 In the event that the Customer decides to withdraw from the Purchase Agreement, he is obliged to inform Vino z Modra of his decision by a clear statement by delivering an e-mail to the address: ahoj@vinozmodry.sk. For this purpose, he can use sample withdrawal form, which is located on the website Wines from Modra. The Customer can also exercise his right to withdraw from the Purchase Agreement through his Account by filling out and sending a sample form for withdrawing from the contract located in the Withdrawal from the contract section.

15.3 Wine from Modra will immediately after receiving the withdrawal from the Purchase Agreement provide the Customer with a confirmation of delivery of the buyer's withdrawal from the Purchase Agreement to the Customer's e-mail address or to the Account message box.

15.4 The customer is not entitled to withdraw from the Purchase Agreement in the event that

(a) Sale of Online Tickets for the event, given that such purchase is considered to be a contract related to the provision of services related to leisure activities and for that reason the Customer cannot withdraw from the Purchase Agreement in accordance with the provisions of Act No. 102/2014 Coll. on consumer protection, as amended, in the sale of goods or the provision of services on the basis of a contract concluded at a distance or a contract concluded outside the seller's premises, and on the amendment of certain laws, as amended. Regardless of the previous one, the Customer is entitled to request the cancellation of the purchase in accordance with the conditions specified below;

(b) The sale of a Product made according to the special requirements of the Customer, a Custom-made Product or a Product designed specifically for one Customer

(c) The sale of a Product which is subject to rapid reduction in quality or spoilage

(d) The sale of a Product enclosed in protective packaging which is not suitable to be returned for health or hygiene reasons and whose protective packaging has been broken after delivery

(e) The sale of a Product which, by its very nature, may, after delivery, be inextricably mixed with other goods

(f) the sale of phonograms, video recordings, audio-visual recordings or computer software sold in protective packaging, if the Customer has unpacked that packaging, the

(g) the sale of periodicals, excluding sales under a subscription agreement, and the sale of books not supplied in protective packaging, the

(h) that the Gift Voucher has already been exchanged for a Ticket.

15.5 Withdrawal from the Purchase Agreement must be complete and properly completed, i.e. all relevant fields in the withdrawal form must be completed. If the withdrawal from the Purchase Agreement is not completed properly, the Customer will be notified by Wine from Modra of errors in the withdrawal form, specifying how to remove them. Acceptance of withdrawal from the contract will be confirmed to the Customer immediately within the Account or by e-mail. Withdrawal from the contract is not validly submitted unless the Customer is confirmed to accept it by delivering a message to the Account or by e-mail. In the event that such confirmation is not delivered to the Customer within 24 hours of dispatch (due to potential technical problems on the part of the consumer), the Customer is obliged to repeat his request to withdraw from the contract. In the event that the Customer, despite the request of Wine from Modra, does not submit a properly and correctly filled out withdrawal form within the period specified in point 9.1 of the General Terms and Conditions, withdrawal from the Purchase Agreement is not valid and Wine from Modra is not obliged to return the Purchase Price to the Customer and Wine from Modra is entitled to reimbursement of the costs associated with sending the Product back to the Customer if it received them from the Customer as part of the withdrawal from the contract.

15.6 After withdrawing from the Purchase Agreement, Wine from Modra will return all payments to the Customer that it made in connection with the conclusion of the Purchase Agreement, in particular the Purchase Price, including the costs of delivering the Products to it. This does not apply to additional costs if the Customer has chosen a different type of delivery than the cheapest common delivery method offered by Wine from Modra. Payments will be returned to the Customer without undue delay, no later than 14 days from the day the Customer's notice of withdrawal from the Purchase Agreement was delivered to her and the condition according to point 9.6 was met. Payment will be made by transfer to the Customer's bank account from which he made the payment of the Approximate Price without charging any additional fees.

15.7 The purchase price will be paid to the Customer after delivery of the returned Product (intact) back to the address of Wine from Modra or upon presentation of a document proving the sending of the Product Wine from Modra, whichever occurs first. The customer is obliged to send the Product back or bring it to the address Vína z Modra no later than 14 days from the date of exercising the right to withdraw from the Purchase Agreement. The deadline is considered to have been met if the Product is sent back by the Customer before the 14-day deadline expires. All costs for returning the Wine from Modra Product are borne by the Customer, including the costs of returning the Product, which due to its nature cannot be returned by post

15.8 The Customer is obliged to consult Wine from Modra in advance using the e-mail sent to Wine from Modra to the e-mail address: ahoj@vinozmodry.sk no later than 7 working days from the date of withdrawal from the Purchase Agreement.

15.9 Cancellation Online tickets can be requested according to Article 2, paragraph 5 of the Complaints Procedure. The application for cancellation of online tickets will be assessed by Wine from Modra.

15.10 The requirement to cancel Online tickets can only be applied to the transaction as a whole, i.e. on all Online tickets purchased through one transaction/order.

15.11 Funds for Online tickets are returned exclusively cashless.

15.12 In the request for cancellation of an Online Ticket, it is necessary to indicate the date and unique number of the transaction made and paid, as well as the name and surname of the Customer and the Customer's email address.

15.13 If during the process of buying an Online Ticket, the amount for the purchase of an Online Ticket was debited from the Customer's account, but the Online Tickets were not displayed to him or sent to the Customer's e-mail, the claim for a refund due to non-provision of the service must be made by the Customer to the bank that issued the payment card through which the payment took place.

15.14 In case of non-participation in the event, the Customer does not have the right to a refund of the Ticket.

15.15 In case of non-use of the Gift Voucher, the Customer does not have the right to a refund of the Gift Voucher.

Art. 17 Alternative dispute resolution

17.1 Alternative resolution of consumer disputes (ARS) is a procedure aimed at achieving an amicable resolution of the dispute between the consumer and the entrepreneur and at preventing the emergence of legal disputes between these two entities. In the event that the Customer is dissatisfied with the result of an attempt to resolve his dispute (complaints, complaints) by Vínu z Modra, he is entitled to turn to an authorized entity of alternative dispute resolution in the dispute matter, which he is in accordance with Act no. 391/2015 Coll. on alternative resolution of consumer disputes and on amendments to certain laws of the Slovak Trade Inspection. Art. 18 Protection of personal data

18.1 The Customer acknowledges that Wine from Modra, when providing Services and when concluding the Purchase Agreement with the Customer, processes the Customer's personal data in accordance with Act no. 18/2018 Coll. Act on the Protection of Personal Data and Amendments to Certain Acts. More information regarding the principles and procedures for processing personal data can be found by the Customer on the Wine from Modra website in the Information section.

18.2 The space of the square and the premises of the Wineries can be monitored by a city camera system with recording, and entrances to the Wineries can be equipped with attendance counting.

18.3 The Visitor grants Vínu z Modra consent to make audio, video and combined recordings of the Customer at the Event for the purpose of media coverage and promotion of the Event.

18.4 Based on current anti-epidemiological measures, the organizer may request information about name, surname and place of residence from the visitor.

18.5 Detailed personal data protection rules The organizer is available on the website www.vinozmodry.sk.

Art. 19 Information on the possibility of submitting suggestions and complaints

19.1 In case of any problems, questions, comments, suggestions and complaints, the Customer can contact Víno z Modra by sending an email to the email address Víno z Modra: ahoj@vinozmodry.sk.

Art. 20 Final provisions

20.1 The rights and obligations not regulated by these GTC, or resulting from them, are subject to the relevant provisions of the legal regulations valid and effective in the territory of the Slovak Republic. The general courts of the Slovak Republic are competent to resolve all disputes that arise in connection with the provision of the Service. This does not affect the Customer's right according to Art. 10 GTC.

20.2 The Slovak Trade Inspection checks compliance with legal regulations in the area of consumer protection. The competent control authority for the Bratislava region is the SOI Inspectorate for the Bratislava region, Prievozská 32, P. O. BOX 5, 820 07 Bratislava 27, department of supervision.

20.3 The control of compliance with legal regulations in the area of food supply and sale is carried out by the State Veterinary and Food Administration. The competent control authority for the city of Modra is the Regional and Veterinary Administration Bratislava-mesto, Polianky 8, 841 01 Bratislava.

20.4 The control of compliance with legal regulations in the area of the offer and sale of food and cosmetic products is carried out by the Public Health Office of the Slovak Republic and regional public health offices. The competent control authority for the city of Modra is the Regional Office of Public Health Bratislava, Ružinovská 8, 820 09 Bratislava.

20.5 These General Terms and Conditions are an integral part of every Purchase Agreement concluded between Wine from Modra and the Customer. In the event that Vino z Modra and the Customer conclude a written Purchase Agreement in which they agree on conditions different from these GTC, the provisions of the written Purchase Agreement take precedence over the provisions of these GTC.

20.6 Wine from Modra reserves the right to change or supplement these GTC at any time. Changes and additions to the General Terms and Conditions enter into force on the day of their publication on the Wine from Modra website. On the day of publication of the new GTC, the previous GTC lose their effectiveness. However, amendments to the General Terms and Conditions will not in any way violate or limit the Customer's rights related to the provision of the Service confirmed by Wine from Modra before the new General Terms and Conditions come into force.

20.7 In the event that any of the provisions of these GTC is declared or considered invalid or non-binding for any reason, its invalidity will not affect the validity or binding nature of the other provisions of the GTC, unless the invalidity of the relevant part fundamentally changes the subject of these GTC.

20.8 These General Terms and Conditions take effect on 1.1.2024.
